Abstract

For the author, the principle of legality is an evolved form of that brief legality characteristic of the constitutional State at the beginning of the 19th century. In fact, when the constitutional State emerged, the law, the sovereign before which we all prostrated ourselves, as an author of the time said, was the legitimate instrument for structuring the new State and a genuine expression of the general will, and accepted in such a way. role as sovereign.
