Approach to the right to non arbitrary discrimination in the regime of Law 19.496

Abstract

In this article the author proposes an analysis on the development of constitutional principle and fundamental right of the right to equality before the law, and the prohibition of arbitrariness in the particular field of consumption acts. To do this, first, sets the rules reconstruction of that principle, then, to devote her attention to the development of the guarantee of equality and prohibition of discrimination contained in the Law 19,496 on issues such as the refusal to the sale or provision service, advertising or abusive surveillance systems, and finally presents the mechanisms of judicial control of contrary to the right to non-discrimination in the consumer legislation.
