The Pro Persona Principle in International Law and Domestic Law as an Interpretative and Normative Rule

Abstract

This article establishes the premise that the pro persona principle in the field of human rights plays a normative and an interpretative role, which allows the delimitation of rights and the solution of normative conflicts of rights. Such principle has an explicit recognition in international human rights law. Once incorporated into domestic legal system, this principle can create legal obligations.
