Notes on the Sanctioning Power of the Administrative Authority and the Principle of Legality

Abstract

This article summarizes the fundamental principles recognized in our legal system and collected by the jurisprudence and doctrine according to which the sanctions that the administration can impose must be clearly and determinedly indicated by a norm of legal hierarchy. It is not possible to delegate this power in an infra-legal norm nor that the administrative authority pretends by itself and before itself to impose them.
