On the Right to Secession in the Independence of Montenegro

Abstract

Secession is probably one of the issues that generates the most discussion in the current internationalist and political-philosophical doctrine, since it has become practically the only mechanism for the modification of international borders, either through the creation of new States or the integration or association with another pre-existing. As there is no doubt that secession regularly occurs in a factual context that makes it difficult to think that the Law is capable of effectively prohibiting it in the event that individuals strongly desire separation, a better theoretical understanding of this phenomenon is required. , so that later such conclusions can be reflected in some way in a peaceful practice of prerogative.
