The responsibility of the State-Judge: Good reasons to propose a broad definition of judicial error in Chile

Abstract

After a review of the regulation and evolution of responsibility State-Judge in Chile, there are good reasons for proposing a broad definition of the concept of judicial error. On the one hand, from the perspective of inocentrismo, the causes of condemning innocent people suggests paying attention to the shortcomings of the criminal proceedings. Furthermore, a model citizen safety becomes alert about its impact on the functioning of the Administration of Justice. Finally, a new proposal for an action for damages for judicial error is exposed.
