The Constitutional Protection in Venezuela

Abstract

This paper analyzes the constitutional protection action (amparo constitucional) established in the Constitution of Venezuela. This action protects constitutional rights, including rights established in international treaties. From a comparatively law perspective, this is an exceptionally broad protection, because the action protects all type of rights -personal, economic, social and cultural- against wrongs committed by to any person -authorities and private persons-including both acts and omissions that cause harm. This work also analyses the procedural aspects of the constitutional protection action, including the exercise of the action for infringement of fundamen­tal rights and freedoms (acción de amparo), the submission of claims for protection jointly with other state acts, jurisdictional aspects, and the basic norms of procedure.
