Abstract

In this paper we will develop a perspective that tackle the discuss on constitutional reform in Chile. This approach gives a priority into a majority decisions, because they are essential components of political equality. To achieve this, we will explain how some critics to Constitution are redirect to institutional design (i) also, we will expose the way of important part of the legal scholars characterized the Constitution as “counter-majoritarian” (ii) as well, we will discuss the arguments which some authors have attempted to develop this feature (iii) in the same way, we will argue why that thesis is incorrect because arguments are questionable (iv) this background, allow us to propose a reasonable model of majoritarian democracy, which should guide the discussion on a new Constitution (v); issue that is specifiable in certain institutional decisions, preliminarily, propose (vi).
